Terms of Service
This agreement applies as between you, the User of this website and AA Comps, the owner(s) of this website. Your agreement to comply with and be bound by these terms and conditions is deemed to occur upon your first use of the website. If you do not agree to be bound by these terms and conditions, you should stop using the website immediately.
- Definitions and Interpretation
In this Agreement the following terms shall have the following meanings:
- “Content” means any text, graphics, images, audio, video, software, data compilations and any other form of information capable of being stored in a computer that appears on or forms part of this website;
- “AA Comps” means AA Comps LTD of Unit 436, Houldsworth Business & Arts Centre, Houldsworth Street, Stockport, Greater Manchester, United Kingdom, SK5 6DA (“AA Comps”, “we”, “us”, or “our”);
- “Service” means collectively any online facilities, tools, services or information that AA Comps makes available through the website either now or in the future;
- “System” means any online communications infrastructure that AA Comps makes available through the website either now or in the future.
- “User” / “Users” means any third party that accesses the website and is not employed by AA Comps and acting in the course of their employment; and
- “website” means the website that you are currently using (aacomps.com).
- Intellectual Property
- All Content included on the website, unless uploaded by Users, including, but not limited to, text, graphics, logos, icons, images, sound clips, video clips, data compilations, page layout, underlying code and software is the property of AA Comps, our affiliates or other relevant third parties. By continuing to use the website you acknowledge that such material is protected by applicable United Kingdom and International intellectual property and other relevant laws.
- You may not reproduce, copy, distribute, store or in any other fashion re-use material from the website unless otherwise indicated on the website or unless given express written permission to do so by AA Comps.
- Legal Compliance
All Competitions offered by AA Comps are in accordance with Section 6.2 of the Gambling Act 2005 skill-based games (knowledge) and chance based and thus fall outside the requirements set out in the Act. Nonetheless, AA Comps warrants to operate and maintain its services on the Website resulting in a fair and objective manner.
- Eligibility
Competitions are open to all persons aged 18 years or over, except: (a) employees of AA Comps; (b) employees of agents or suppliers of AA Comps, who are professionally connected with the Competition or its administration; or (c) members of the immediate families or households of (a) and (b) above.(d) Each competition will have its own countdown timer & end date, we reserve the right to sell tickets/numbers until the countdown timer runs out.
- How to play
- When a competition is active you can participate by answering a skill based question (knowledge) and buying the ticket assigned to each competition. There may be a single Competition, multiple competitions may be operated at the same time and each Competition will have its specific Prize.
- When entering a skill based competition, you will need to answer a skill based question (knowledge) questions. Wrong answers to this competition will not be allowed to enter in the competition.
- AA Comps will not accept: (a) responsibility for entries to the Competition that are lost, mislaid, damaged or delayed in transit, regardless of cause, including, for example, as a result of any postal failure, equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind; or (b) proof of posting or transmission as proof of receipt of entry to the Competition. To the extent permitted by applicable law, all entries become our property and will not be returned. (c) Any responsibility for failure of technical systems, such as distribution of random or manually selected numbers allocated by the ticketing system and if in the rare event of a duplicate number has been produced and dispatched via the ticketing system, any prize won by two or more participants with a duplicate number, will be fully compensated with monetary value determined by a valuation of the prize agreed upon by the promoter and winning participants, the participant who purchased there ticket/number(s) first will be the participant eligible to receive the prize.
- Competitions and Prizes
- From time to time AA Comps will run competitions on this website. Competitions may be subject to additional terms that will be made available at the time.
- We will use the information you supply to process your competition entry.
- It is assumed that by entering Competitions which, if won, could result in time off work, your employer has agreed to allow you time off. When dates are specified, they cannot be altered and by entering date-related Competitions AA Comps or the third party are not liable in any way to any winner who cannot attend.
- Entries in the incorrect format will not be considered.
- Unless otherwise stated, only one Competition entry, fulfilling the eligibility requirements above, will be accepted per person. Spammers will be disqualified.
- Entrants will be deemed to have accepted these Terms and to have agreed to be bound by them.
- Once selected, only the winner(s) will be contacted personally by email using the contact details provided upon entry.
- Winners will be notified on the day that the winner is selected. Winners will have 5 (five) working days to respond in full or another winner will be selected.
- AA Comps’ decision is final in every situation, including any not covered above, and no correspondence will be entered into in respect of the validity of any such decision.
- AA Comps shall be permitted to exclude or disqualify any entrant at any time at its sole discretion.
- AA Comps reserves the right to exclude late, incomplete or multiple registrations, or registrations made by third parties or agents.
- Entry to the Competition and acceptance of the prize constitutes permission to use any entrant’s name, image and any competition entry photograph for promotional and/or editorial purposes in any format in print and non-print media without additional consultation.
- Prizes must be taken as stated and cannot be deferred, although AA Comps reserves the right to change the prize in the event of unforeseen circumstances. There will be no cash alternative.
- AA Comps reserves the right to (i) cancel and/or withdraw this Competition and/or (ii) amend these Terms, at any time without notice.
- To the fullest extent permitted by applicable law, in no event will AA Comps be liable, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, for any loss, damage or injury arising under or in connection with this Competition.
- Links to Other websites
This website may contain links to other sites. Unless expressly stated, these sites are not under the control of AA Comps or that of our affiliates. We assume no responsibility for the content of such websites and disclaim liability for any and all forms of loss or damage arising out of the use of them. The inclusion of a link to another site on this website does not imply any endorsement of the sites themselves or of those in control of them.
- Winners’ Personal Data
Acceptance of the prize by the Winner will mean they are required to have their photo and video taken by the Promoter for promotional purposes (Public Relations and Marketing), both immediately after their win and in the future for use.
- Privacy
- For the purposes of applicable data protection legislation, AA Comps will process any personal data you have provided to us in accordance with our Privacy Policy.
- You agree that, if you have provided AA Comps with personal data relating to a third party (1) you have in place all necessary appropriate consents and notices to enable lawful transfer such personal data to AA Comps and (2) that you have brought to the attention of any such third party our Privacy Policy. You agree to indemnify AA Comps in relation to all and any liabilities, penalties, fines, awards or costs arising from your non-compliance with these requirements.
- Disclaimers
- AA Comps makes no warranty or representation that the website will meet your requirements, that it will be of satisfactory quality, that it will be fit for a particular purpose, that it will not infringe the rights of third parties, that it will be compatible with all systems, that it will be secure and that all information provided will be accurate. We make no guarantee of any specific results from the use of our Service.
- No part of this website is intended to constitute advice and the Content of this website should not be relied upon when making any decisions or taking any action of any kind.
- Availability of the website
- The Service is provided “as is” and on an “as available” basis. We give no warranty that the Service will be free of defects and / or faults. To the maximum extent permitted by the law we provide no warranties (express or implied) of fitness for a particular purpose, accuracy of information, compatibility and satisfactory quality.
- AA Comps accepts no liability for any disruption or non-availability of the website resulting from external causes including, but not limited to, ISP equipment failure, host equipment failure, communications network failure, power failure, natural events, acts of war or legal restrictions and censorship.
- Limitation of Liability
- To the maximum extent permitted by law, AA Comps accepts no liability for any direct or indirect loss or damage, foreseeable or otherwise, including any indirect, consequential, special or exemplary damages arising from the use of the website or any information contained therein. Users should be aware that they use the website and its Content at their own risk.
- Nothing in these terms and conditions excludes or restricts AA Comps’s liability for death or personal injury resulting from any negligence or fraud on the part of AA Comps.
- Every effort has been made to ensure that these terms and conditions adhere strictly with the relevant provisions of the Unfair Contract Terms Act 1977.
- No Waiver
In the event that any party to these Terms and Conditions fails to exercise any right or remedy contained herein, this shall not be construed as a waiver of that right or remedy.
- Previous Terms and Conditions
In the event of any conflict between these Terms and Conditions and any prior versions thereof, the provisions of these Terms and Conditions shall prevail unless it is expressly stated otherwise.
- Severance
In the event that any of these terms are found to be unlawful, invalid or otherwise unenforceable, that term is to be deemed severed from these terms and conditions and shall not affect the validity and enforceability of the remaining terms and conditions. This term shall apply only within jurisdictions where a particular term is illegal.
- Law and Jurisdiction
These terms and conditions and the relationship between you and AA Comps shall be governed by and construed in accordance with the Law of England and Wales and AA Comps and you agree to submit to the exclusive jurisdiction of the Courts of England and Wales.
